Francisco Verdún has published the article "The Court of Justice of the European Union ruling on the 29th October 2015 in the BBVA case: analysis of its possible consequences" in the law journal CESCO (consumer law) redacted by the University of Castilla-La Mancha (number 19, November 2016)

 

In the light of the Community objective of ensuring a high level of consumer protection, this article analyzes a number of juridical consequences that might be derived from the BBVA judgment, among others, the urgent demand of an amendment of the Spanish legislation, the duty of the national courts to act of their own motion in the cases concerned and the possibility of the litigant to bring an action for damages against the State as a result of a breach of European Union law.

Francisco Verdún publishes the article "The possible infringement of the European Union law by the UEFA Financial Fair Play regulations" in one if the most prestigious European Union law journals  (Aranzadi Unión Europea,number 6, June 2017).

Starting from the assumption that Financial Fair Play regulations fall under the scope of European Union law, this article analyzes the possible non-compliance of the  said rules with the European Union law, particularly, with respect to articles 101 and 102 of the Treaty on the Functioning of the European Union in connection with principles of proportionality and legality as well as with the right to an effective judicial protection and principle of effectiveness.

Francisco Verdún publica el artículo "La posible vulneración del Derecho de la Unión Europea por parte de las normas del Fair Play financiero de la UEFA" en la prestigiosa revista ARANZADI UNIÓN EUROPEA (Num. 6, junio 2017).

A partir de la premisa de situar dentro del ámbito de aplicación del Derecho de la Unión Europea las normas del Fair Play financiero, dicho artículo examina la posible disconformidad de las mismas con el Derecho de la Unión, en especial, con los artículos 101 y 102 del Tratado de funcionamiento de la Unión Europea en relación con los principios de proporcionalidad y legalidad así como con el derecho a la tutela judicial efectiva y el principio de efectividad.
